Each drug has a different trafficking weight, and if you are found to be in possession of a drug in an amount equal to or greater than the statutorily defined trafficking weight, you may be facing a very stiff minimum mandatory trafficking sentence.
~ Simple possession occurs when someone is found to be in actual or constructive possession of an illegal substance.
Possession with intent to distribute
~ Possession with intent to distribute is the same as simple possession, but involves a greater amount of the drug in question. Regardless of your actual intent, the law will presume you intended to distribute certain drugs if you are found to be in possession of the requisite quantity or weight. Possession with intent weights are less than trafficking weights, although they’re both felonies.
